Attorney Tax Christ Church spokesman Marc Weinstein declined to comment last week when asked whether an eminent domain action would prompt a lawsuit from the church.

Guide Law Tax The Washington, D.C.-based Becket Fund, an advocacy group that defends churches in court, has said that it would represent Christ Church if its application is rejected by the township.

Tax Accountant State Assemblyman Michael Patrick Carroll, R-Morris Township, an attorney who offered to represent Christ Church last year, said the district might have a tough time defending an eminent domain action in court.

Accountant Tax "There is some law that says you cannot use eminent domain to prevent a particular application. If it was found that the school district was doing this to defeat the (Christ Church) site plan, that would be an issue," Carroll said.

Federal Income Tax While Agilent no longer has employees at the site, the company continues to pay approximately $630,000 in annual property taxes to the township. Churches are tax-exempt organizations.

The Real Estate Investor Tax "I certainly think a (public) school would be preferable to the Christ Church project. Even though we'd still be out the tax money, it's at least something for the people of Rockaway Township," Mueller said.

State Tax The facilities study committee whittled the list of potential school sites from 30 to three over several months, lead architect Kevin Settenbrino said last week. A nine-person delegation from the district, including eminent domain attorney James Turtletaub, toured the Agilent property in December.
